- All Materials submitted by Manufacturer to Information Handling Services,
Inc. (IHS), are subject to the following terms and conditions.
- The following words and phrases have the meanings indicated:
- IHS --
Information Handling Services, Inc., a Colorado corporation
- Manufacturer -- any person, corporation,
or other entity that submits any Materials to IHS for publication
- ERC -- the Engineering Resource Center, part of the IHS Engineering website, a site on the World Wide Web owned and maintained by IHS (or any successor or alternative site)
- Materials
-- any information submitted by Manufacturer to IHS in any format, including
written and electronic, such as catalogs, directory listings, sales literature,
test data, fliers, technical data sheets, price lists, and parts
listings
- Manufacturer grants to IHS the right to disassemble, copy, scan, edit, convert
to electronic format, index, and otherwise prepare the Materials for publication.
- Manufacturer grants to IHS the right to publish the Materials on the IHS Engineering website in such format as IHS deems appropriate.
- Manufacturer warrants that it is the owner of the Materials and is authorized
by law, including applicable United States and international copyright provisions,
to allow them to be disseminated on the World Wide Web. All Materials submitted
become the property of IHS and will not be returned.
- Manufacturer may request in writing that IHS withdraw Manufacturer's materials from the ERC. IHS shall comply with such a request within thirty (30) days of receipt.
- IHS disclaims any warranty in the preparation or publication of the Materials.
- Manufacturer agrees to indemnify and hold IHS harmless from the claims of
any third party arising out of the use of the Materials.
- These Terms and Conditions may be amended from time to time and posted on the
IHS Data Acquisition web site. Manufacturer agrees to abide by these Terms and
Conditions as they are in effect at any time that Manufacturer submits any Materials
to IHS.
- These Terms and Conditions are governed by the laws of the State of Colorado.
- Any legal action between Manufacturer and IHS shall be brought in the State of Colorado.
